This privacy statement will inform you of the processing of your personal data via the website of BIM Supporters B.V. (“BIM Supporters”). BIM Supporters is on a mission to improve the quality of BIM usage around the world.

BIM Supporters is the data controller. We understand that you wish to protect your privacy and your personal data. We will always process your personal data in accordance with the applicable laws and regulations concerning data protection, such as the General Data Protection Regulation and the Dutch Telecommunications Act. This privacy statement informs you of the way in which we collect, process and protect your personal data, for what purposes and on which legal grounds.

Your personal data
We will not process your personal data for any other purposes than stated in this privacy statement. Your personal data will not be retained any longer than is necessary for the purposes for which the data was collected, unless further processing of your data is required by any data protection laws and regulations.

We will ask your prior consent for the processing of your personal data, unless we have a legitimate interests hereto. If the processing is based on  your consent, you have the right to withdraw this consent at any time. Please be aware that this withdrawal will not affect the lawfulness of the processing based on consent before its withdrawal.

Contact form
Via our website you can contact us via our contact form. To answer your inquiry and to contact you we ask you to fill in your name and your e-mail address.

You may also submit a complaint via our specific complaint contact form. We ask you to fill in your first and last name, your e-mail address and a description of your complaint. It is possible to send in additional documents. We will send you an e-mail when we have received your complaint. We will contact you via e-mail if we need more information or when our investigation is complete.

When you have a membership, you may send us feedback or contact us through the account page.

Newsletter
You can opt in to receive monthly newsletters and other updates from BIM Supporters about best practices, news articles or new products. To send these newsletters and updates we need your e-mail address. You can unsubscribe from receiving our newsletters at any time by clicking on the link at the footer of every newsletter.

Memberships
You can sign up for a free and/or a full membership via our website. With our free membership you can use all tools, for free, for as long as you want. In order to sign up for such a membership, we ask you to fill in your first and last name, your e-mail address and a password. To sign up for a full membership you must fill in your first and last name, your current address, city, country and postal code, your e-mail address and a password. Please keep the combination of your e-mail address and password a secret. When you register on behalf of a company, we also ask your company name and VAT number.

Via your account page you can update and extend your account info, download your invoice or send us some feedback. You can also find an overview of your subscriptions and payments. Your membership will automatically stop after one year, unless you explicitly extend your membership.

Consultants
If you are interested in becoming a Certified Consultant for BIM Supporters, you can apply for certification via the intake form on our website. We ask you to fill in your first and last name, your e-mail address, current address, city, country, postal code and the company you currently own or work for. This information is stored as long as the intake procedure is in progress, and archived after closing of that process.

When you register as a Certified Consultant, we ask the VAT number of your organization. Your Name, e-mail address, operating address and expertise will be publicly available on our website (during the period you are active as a Certified Consultant), in order for potential clients to search for a Certified Consultant.

Cookies
We make use of certain cookies on this website. Cookies are small pieces of data sent by a website and saved by your web browser.

Google Analytics
When you login to our online portal, we make use of cookies from Google Analytics to obtain information on the quality and effectiveness of this website. We also use advanced functions of Google Analytics to analyze user sessions. Therefore we send identifiers to Google, including information about your browser, operating system, and your logged-in/out status. We do not use the remarketing variable, nor the tracking features of Google. These cookies are solely used for analytical purposes and will not have a noticeable impact on your privacy. We have entered into a data processing agreement with Google and we will not share any data with Google for any other purposes than mentioned above.

Functional cookies
We use service cookies that help us to make our website work as efficiently as possible. These cookies expire when the browsing session ends. You can automatically disable or delete cookies by adjusting your browser preferences and settings. This may impact your experience of this website.

Your rights
Since we collect and use your personal data, you have the right to request from us access to and rectification or erasure of personal data or restriction of processing concerning your personal data, and to object to processing as well as the right to data portability.

Regarding the processing of your personal data by BIM Supporters you thus have the right to:

  • obtain confirmation as to whether or not your personal data are being processed, and, where that is the case, access the personal data and other information relating hereto;
  • obtain rectification of inaccurate personal data and to have incomplete personal data completed;
  • obtain the erasure of your personal data, where the personal data is no longer necessary, you have withdrawn your consent and there is no other legal ground for the processing, you have objected to the processing, and/or where your personal data have been unlawfully processed;
  • obtain the restriction of processing, where the accuracy of your personal data is contested, the processing is unlawful, your personal data are no longer necessary for BIM Supporters B.V. but you require those in relation to legal claims, and/or where you have objected to the processing and this objection is pending;
  • receive your personal data in a structured and machine-readable format and to transmit these data directly to another data controller.

We will respond to your request within four weeks. If you do not agree with the contents hereof, the rejection of your request, or the processing of your personal data in any other way, you are entitled to lodge a complaint with the Dutch Data Protection Authority.

Non-Personal data
When using the software tools, you input non-personal data on how your organization uses, or wishes to use BIM technology. We store and use this information so you can review it, and share it with others. When you hire a Certified Consultant, the consultant will provide the data on behalf of you. In that situation, the Certified Consultant will be able to view your data as well. You will stay the owner of your data.

The data you input is stored in our database. It is used to calculate and anonymously present industry averages of BIM usage. We also use the anonymized data to perform research on BIM usage. The anonymized data will also be available for Certified Consultants to support them in their advice activities. We try to ensure this data cannot be traced back to an individual organization. This data cannot be used to identify certain individuals.

Third parties
Some of the personal data collected is shared with third party services providers and our business partners. We currently share your e-mail address with MailChimp in order to send you our newsletter if you have opted to receive these. MailChimp processes your data in reliance on the EU U.S. Privacy Shield, which ensures an adequate protection.

All our data and tools are hosted at servers from WPEngine, Inc. The servers are located in datacenters from Google located in Brussels and/or Frankfurt.

We use Paypal for our payments. Some of your data is shared between BIM Supporters and Paypal to allow communication about payments.

We will solely share your personal data where you have given us your explicit consent hereto, or where this is necessary for the performance of a contract, a legal obligation or for legitimate interests of BIM Supporters, or where we are obliged to disclose your personal data on the basis of a request by or order of a competent authority.

If your personal data will be transferred to parties that are not located within the European Union, we will make sure that there is an adequacy decision of the European commission in place, or that there are other appropriate safeguards set up.

Security measures
We have implemented the appropriate technical and organizational measures to ensure that your personal data will be processed in accordance with the applicable data protection laws and regulations, and to ensure a high level of security and integrity of your personal data. We make use of an sha256RSA encrypted communication protocol on our website (HTTPS), to protect the exchanged data. Our security certificate is a COMODO RSA Extended Validation Secure Server CA, valid until ‎Saturday ‎June 15, ‎2019 1:59:59

Other
We may change or modify this privacy statement from time to time. We will only process your personal data in accordance with the privacy statement that applied at the time your personal data was collected.
